The terms governing the use of the Kveik Yeastery website, resources and services.
These Terms & Conditions apply to all sales and deliveries of products, materials and services offered by Enzyferm AS ("Supplier").
By purchasing products or using services provided by Enzyferm AS, the customer agrees to be bound by these Terms & Conditions.
A customer may place an order by submitting a written purchase order or by using an online ordering system provided by the Supplier.
An order becomes binding only when the Supplier issues a written order confirmation specifying the products, pricing, delivery terms and payment conditions.
The customer may not transfer or assign an order or contract to any third party without prior written approval from the Supplier.
All product information, specifications, technical descriptions and performance data are provided for guidance purposes only.
The customer is solely responsible for determining whether a product is suitable for its intended use.
Unless specifically agreed in writing, the Supplier does not guarantee that a product will meet any particular customer requirement or application.
Prices are stated in the applicable order confirmation.
Unless otherwise agreed, invoices are payable within 15 days from the invoice date.
The Supplier reserves the right to adjust prices prior to delivery in the event of increased costs relating to raw materials, freight, energy, labour, taxes or other external factors.
Failure to make payment does not release the customer from its contractual obligations.
Estimated delivery dates are provided in good faith but are not guaranteed unless expressly stated otherwise in writing.
The Supplier shall not be liable for delays caused by circumstances outside its reasonable control, including supply chain disruptions, transportation delays, force majeure events or customer-related issues.
Risk of loss or damage passes to the customer upon delivery or transfer to the carrier.
Customers must inspect products immediately upon receipt.
Any claims relating to shortages, defects or delivery errors must be submitted in writing within the applicable inspection period.
Failure to notify the Supplier within the required timeframe may result in the products being deemed accepted.
The Supplier provides a limited warranty covering manufacturing defects.
The warranty does not apply to defects resulting from:
Warranty claims must be submitted promptly and no later than three months after delivery unless otherwise agreed.

These remedies constitute the customer's exclusive warranty rights.
All intellectual property rights relating to products, trademarks, documentation, specifications, technical materials and website content remain the property of Enzyferm AS or its licensors.
Nothing in these Terms & Conditions transfers ownership of intellectual property rights to the customer.
No material may be reproduced, distributed or used commercially without prior written permission.
To the fullest extent permitted by law, Enzyferm AS shall not be liable for any indirect, incidental, consequential, special or punitive damages.
This includes, but is not limited to:
The Supplier's total liability arising from any claim shall not exceed the amount paid for the specific product giving rise to the claim.
Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.
The Supplier may collect and process personal data necessary for:

The Supplier shall not be liable for failure or delay in performing its obligations where such failure results from events beyond its reasonable control.

The parties shall seek to resolve disputes through good-faith negotiations before pursuing legal action.
